The Civil Aviation Authority (CAA) is planning a draft circular which would make it necessary for domestic airlines to compensate as much as USD150 per passenger for a delayed flight. According to the CAA, a flight departing 15 minutes late would be considered delayed. The proposal was brought up after it was brought to public attention that the number of cancelled and delayed flights was increasing, mostly with the low-cost carriers. The Ministry of Transported listed compensation rates for passengers on delayed and canceled flights eight years ago, but many people have said that the rates were too low. On domestic routes, each passenger with more than a four-hour delay, will now be compensated VND200,000 if the flight exceeds 500 km, and VND400,000 for one 1,000km or over. Delayed or cancelled flights will cost airlines at least VND100,000 more in compensation to each affected passengers under a new proposal by the Civil Aviation Authority of Vietnam to the Transport Ministry. Flights that take off 15 minutes later than scheduled are considered delayed, while a cancellation occurs when flight schedules still exist in the system 24 hours before takeoff, but the airline does not operate the flight. On domestic routes, each passenger delayed will now get VND300,000 if the flight is longer than 500km, and VND400,000 flights of more than 1,000km. Compensation on international routes will remain at USD25 for any flight less than 1,000km, USD50 for 1,000km and more and USD150 for a flight of 5,000km or more. Figures from the CAAV also showed that Jetstar Pacific topped the list of airlines with the highest rate of delayed fights at 25.1 per cent, followed by VietJet Air, Vietnam Airlines and Vasco. Viet Nam Airlines had the most number of cancelled flights at 58, followed by VietJet Air with 18. Jetstar Pacific cancelled only one flight while Vasco had no cancellations. Air passengers in Vietnam are now entitled to refunds when their flights are delayed by five hours or longer. The rule, set by the Ministry of Transport in a new circular, took effect Sunday and is a welcome development among local travelers. In Vietnam, many airlines have been criticized for bad treatment towards customers in the event of flight delays and cancellations. It was the first time the transport ministry explicitly stated the rule, even though the right to ask for refunds had been previously stipulated in Vietnam’s laws. In the new circular, the ministry continued to include regulations on airlines’ “minimum obligations” to their passengers in case of flight delays and cancellations. Among these obligations, affected passengers have to be provided accommodations while waiting for their next flights.
