Biden’s court-packing theater could tame the Supreme Court’s conservatives
It is human nature that we tend to remember the bright side of history, especially when it’s the side that supports lessons we hope to apply in the here and now. It gives us comfort that the sky is not falling. So it is with conservatives and the Biden court-packing theater, also known as the Presidential Commission on the Supreme Court . Court-packing, of course, became a major issue in the 1930s, when progressives were, as today, both ascendant and frustrated. They consolidated power thanks to President Franklin D. Roosevelt’s landslide 1936 reelection, with his coattails increasing the Democrats’ supermajority lock on both congressional chambers. Yet core New Deal agenda initiatives that strained against constitutional limits on central government power were blocked by a conservative-leaning Supreme Court. ADVERTISEMENT FDR’s court-packing threat failed, ostensibly. That last little word — ostensibly — is the one we like to forget. We’d rather remember that … [Read more...] about Biden’s court-packing theater could tame the Supreme Court’s conservatives
Uber tells Europe’s top court that taxi app is a “digital economy” champ
A legal decision which has potential ramifications for Uber, tech firms, the so-called "digital economy," and many thousands of taxi drivers is expected no sooner than March, Europe's top court said on Tuesday. The point of law ruling, which will be made by a 15-strong panel of senior judges at the Court of Justice of the European Union (CJEU), could settle a debate that's been rumbling away for more than half a decade: is Uber a transport firm, or—as the company and its lawyers claim—an "information society service?" The case was brought against the California-based firm by a coalition of regulators and taxi firms. Depending on the outcome, it could set a precedent for other tech companies operating under the banner of a "digital platform," including household names like Airbnb and Deliveroo. Representations were made on behalf of the European Commission and several EU countries, and the decision will affect all 28 member states. At its core, the court is expected to answer a … [Read more...] about Uber tells Europe’s top court that taxi app is a “digital economy” champ

Pub owner jailed for 9 years after death of boy, 7, electrocuted by pub garden lights
A pub landlord has been jailed for nine years following the death of a seven-year-old boy who was electrocuted in a pub garden by faulty lights installed by an electrician. The electrician himself, 74-year-old brother-in-law Colin Naylor, was jailed for a year. Judge Martyn Zeidman QC said: "This pub was a disgrace. And as has been said sums it up, in my view, a timebomb waiting to go off." Naylor fitted the outside lights at the King Harold pub in Romford, east London - run by Bearman, 73 - on September 11 2018. But three months later schoolboy Harvey Tyrrell was tragically killed after suffering a fatal shock while sitting on a wall and holding a metal railing. Naylor was found not guilty of gross negligence manslaughter in February but was convicted of failing in his duty to protect people from death and injury under the Health and Safety at Work Act by a jury of 10 in a unanimous decision. Bearman had previously pleaded guilty to gross negligence manslaughter and … [Read more...] about Pub owner jailed for 9 years after death of boy, 7, electrocuted by pub garden lights
